Terms of Service
1. Acceptance of these Terms
These Terms of Service ("Terms") are a binding agreement between you and MineXHost LLC ("MineXHost", "we", "us"), a limited liability company organized in the Commonwealth of Pennsylvania, United States. By creating an account, placing an order, or using any MineXHost service you agree to these Terms, our Privacy Policy, Refund Policy and Acceptable Use Policy, which are incorporated by reference. If you do not agree, do not use the Service.
2. The Service
MineXHost provides managed Minecraft game-server hosting and related features (server provisioning, modpack/plugin installation, backups, subdomains, file and console access, and DDoS-protected networking). Specifications, included resources and prices are described at the point of sale and may change for future billing periods on notice.
3. Accounts & eligibility
- You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract. If you are under 18 you confirm a parent or guardian agrees to these Terms on your behalf.
- You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account.
- One person or legal entity may not maintain multiple accounts to abuse trials, promotions, or resource limits.
4. Billing, renewals & taxes
- Paid plans are billed in advance on a recurring basis (monthly unless stated otherwise) and renew automatically until cancelled. Payment is processed by our payment provider (Stripe); we do not store your full card number.
- You may cancel a subscription at any time from your account; cancellation takes effect at the end of the current paid period and the server remains available until then.
- Prices are exclusive of taxes unless stated; you are responsible for any applicable taxes. Failed or reversed payments may lead to suspension (see §9).
5. Refunds
Refunds are governed by our Refund Policy. In summary, new hosting services carry a 3-day (72-hour) money-back guarantee on first-time purchases; outside that guarantee, eligible refunds are issued at MineXHost's discretion. Refunds are processed back to the original payment method by our staff; financial records of all transactions are retained as required by law.
6. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy. Prohibited activity (including illegal content, attacks on others, and abuse of shared resources) may result in immediate suspension or termination.
7. Your content & data
You retain ownership of the worlds, mods, configurations and other data you upload ("Your Content"). You grant MineXHost the limited rights needed to host, back up, transmit and operate the Service on your behalf. You are responsible for having the rights to any third-party mods, plugins or content you install, and for complying with their licences. We process personal data as described in the Privacy Policy.
8. Availability & support
We target high availability and provide support through the channels listed on the Support page, but the Service is provided on a commercially reasonable-efforts basis. Any uptime commitment, and the sole remedy for missing it, is as stated in the plan description; absent a stated SLA, no specific uptime is guaranteed.
9. Suspension & termination
- We may suspend or terminate your account or a server for non-payment, violation of these Terms or the AUP, suspected fraud or abuse, or to protect the Service or other customers.
- You may stop using the Service and delete your account at any time. Deleting your account erases your personal data as described in the Privacy Policy; financial records are retained as required by law.
- On termination, server data may be permanently deleted after any stated retention window. Export anything you wish to keep beforehand.
10. Disclaimers & limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. To the fullest extent permitted by law, MineXHost's total liability arising out of or relating to the Service is limited to the amount you paid us in the three (3) months preceding the claim, and we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill. Nothing limits liability that cannot be limited under applicable law.
11. Changes to the Service or Terms
We may update these Terms; material changes will be posted here with an updated effective date and policy version, and where required we will notify you. Continued use after changes take effect constitutes acceptance.
12. Governing law & disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of -laws rules. The courts located in the Commonwealth of Pennsylvania, United States have exclusive jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings in your place of residence.
