Please read these terms carefully before using our services

Welcome to MineXHost. These Terms of Service ("Terms") govern your access to and use of our Minecraft server hosting services, website, control panel, and related services (collectively, the "Services"). By creating an account, placing an order, or using our Services, you agree to be bound by these Terms.
If you are using our Services on behalf of an entity (including a corporation, school, organization, non-profit, or other legal entity), you represent that you have the authority to bind that entity to these Terms.
1.1 Material Changes
We may modify these Terms at any time. For material changes to pricing, refund policy, liability limitations, or dispute resolution procedures, we will provide at least 30 days written notice to you. If you do not agree with such material changes, you have the right to terminate your services within that 30-day period and receive a pro-rata refund for the unused portion of your current billing period. Continued use of our Services after the 30-day notice period constitutes acceptance of the modified Terms.
Important: If you do not agree with these Terms, you must not use our Services. For non-material changes, we reserve the right to modify these Terms at any time, and continued use constitutes acceptance.
2. Description of Services
MineXHost provides Minecraft server hosting services including:
- Virtual Minecraft game servers with allocated RAM, CPU, and storage resources
- Web-based control panel for server management (Pterodactyl Panel)
- DDoS protection and network security
- Automated backup services
- Technical support via ticket system and Discord (see About page for hours)
- One-click modpack and plugin installation
Service specifications, including hardware allocations and features, are described on our website and may be updated periodically.
3. Account Registration
3.1 Eligibility
You must be at least 13 years of age to use our Services. Users aged 13 and above may create accounts. If you are under 18 years of age, you represent that a parent or legal guardian has reviewed and agrees to be bound by these Terms on your behalf. Users under 13 years of age cannot use our Services. We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect personal information from children under 13. MineXHost may require age verification documentation at any time to ensure compliance with these age restrictions.
3.2 Account Responsibilities
When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain the security and confidentiality of your account credentials
- Immediately notify us of any unauthorized access or security breach
- Accept responsibility for all activities under your account
- Not share, transfer, or sell your account to third parties
4. Payment Terms
4.1 Pricing and Billing
Service prices are displayed in US Dollars (USD) and are billed on the cycle selected at checkout (monthly, quarterly, or annually). Prices are subject to change with 30 days notice for existing customers.
4.2 Payment Methods
We accept major credit cards (Visa, MasterCard, American Express, Discover), PayPal, and cryptocurrency payments (Bitcoin, Ethereum). All payments are processed securely through third-party payment processors.
4.3 Automatic Renewal and Recurring Billing
AUTOMATIC RENEWAL NOTICE: Your service subscription will automatically renew at the end of each billing cycle (monthly, quarterly, or annually) at the then-current price, and your payment method will be charged accordingly, unless you cancel before the renewal date. MineXHost will send you a billing reminder email at least 5 days before your renewal date. You may cancel auto-renewal at any time through your billing dashboard — no phone calls or emails required. Cancellation prevents future renewal charges and takes effect at the end of the current billing period. No refunds are provided for partial billing periods after the initial 7-day refund window. These terms comply with the FTC Negative Option Rule and the Restore Online Shoppers Confidence Act (ROSCA).
4.4 Late Payment
Services may be suspended if payment is not received within 7 days of the due date. MineXHost will send at least 2 payment reminder emails before suspension. Accounts with invoices unpaid for more than 30 days may be terminated, and all data may be permanently deleted.
4.5 Refunds
Refunds are provided in accordance with our Refund Policy. New customers may request a full refund within 7 days of their first purchase, limited to one refund per customer. After 7 days, refunds are reviewed on a case-by-case basis.
4.6 Chargebacks and Payment Disputes
If you dispute a charge through your payment provider, please contact our support team first to resolve the issue. MineXHost will attempt to resolve payment disputes directly with you before escalating to chargeback processes. Filing a chargeback or payment dispute without attempting direct resolution may result in service suspension or account termination, and you may be liable for chargeback fees imposed by payment processors. Please use our refund process or contact support — it is faster and the preferred method to resolve billing concerns.
5. Acceptable Use Policy
You agree to use our Services only for lawful purposes and in accordance with these Terms. The following activities are strictly prohibited:
5.1 Prohibited Content
- Hosting, distributing, or linking to illegal content
- Content that infringes intellectual property rights (pirated games, software, media)
- Malware, viruses, or malicious code distribution
- Phishing, scamming, or fraudulent activities
- Content promoting violence, hate speech, or discrimination
- Child sexual abuse material (CSAM) - will result in immediate termination and law enforcement notification
5.2 Prohibited Activities
- Attempting to gain unauthorized access to other systems or accounts
- Launching DDoS attacks or participating in botnets
- Port scanning or network reconnaissance of other systems
- Cryptocurrency mining (unless using a plan that explicitly permits it)
- Running unrelated or resource-intensive non-Minecraft services (e.g., websites, databases, proxies, game servers other than Minecraft) without written permission
- Reselling services without written permission
- Excessive resource usage that impacts other customers
- Circumventing resource limits or security measures
5.3 Enforcement Procedures
When MineXHost detects a violation of this Acceptable Use Policy, the following procedures apply:
- Notice: We will provide written notice of the violation including a description of the prohibited activity and the relevant policy section.
- Cure Period: For non-severe violations, you will be given 72 hours to remedy the violation. Severe violations (illegal activity, CSAM, active attacks, unauthorized access) will result in immediate suspension without a cure period.
- Suspension and Termination: If the violation is not cured within 72 hours, or if the violation is severe, we may suspend or terminate your service immediately.
- Appeal Process: You may appeal a suspension or termination within 10 business days by submitting a detailed explanation through our support system. MineXHost will review and respond to appeals in good faith.
- Two-Strike Rule: If you commit a second substantive violation within 12 months, your account will be permanently terminated without further warning or opportunity to cure.
Warning: Violation of this Acceptable Use Policy may result in service suspension, termination, data deletion, and loss of access without refund. Illegal activities will be reported to appropriate authorities.
6. Resource Usage and Fair Use
Our services are designed for Minecraft server hosting. RAM and storage are allocated as dedicated resources. CPU and network resources may be shared with other customers. Excessive or abusive CPU usage that degrades performance for other customers may result in throttling or service review.
Before throttling your resources, MineXHost will notify you of the issue and offer an upgrade to a plan with higher resource allocations. Minecraft server types with known high resource consumption (e.g., heavily modded servers, large player counts) should select appropriately sized plans. We reserve the right to require upgrades for servers consistently exceeding their plan's intended capacity.
7. Data and Backups
7.1 Your Data
You retain ownership of all data you upload to or create on our Services. You grant MineXHost a limited license to store, process, backup, and transmit your data solely for the purpose of providing and maintaining our Services.
7.2 Backups
We provide automated backup services as described in your plan. However, backups are provided "AS-IS" as a convenience and are NOT guaranteed. You are ultimately responsible for maintaining your own independent backups of critical data. We recommend downloading regular local copies of your server files. MineXHost is not liable for any data loss, whether or not backups are available.
7.3 Data Retention
Upon service cancellation or termination, your data will be retained for 14 days before permanent deletion. During this 14-day period, you may request a backup export or account reactivation. After 14 days, data recovery is not possible.
Important: MineXHost is not liable for any data loss. You are responsible for maintaining independent backups. Backups are not retained after account termination. Once deleted, data cannot be recovered under any circumstances.
8. DMCA Safe Harbor
8.1 Designated DMCA Agent
MineXHost designates the following agent to receive copyright infringement notices under the Digital Millennium Copyright Act (DMCA):

8.2 Notice Requirements
If you believe content hosted on MineXHost services infringes your copyright, you may submit a DMCA notice. Your notice must include:
- A physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and its location on our services
- Your contact information (name, address, phone, email)
- A statement that you have a good-faith belief the use is not authorized
- A statement under penalty of perjury that the above information is accurate
8.3 Counter-Notice Procedures
If your content is removed due to a DMCA notice, you may submit a counter-notice within 10 business days. A valid counter-notice must include:
- Your physical or electronic signature
- Identification of the removed content
- A statement under penalty of perjury that the removal was done in error
- Your contact information and statement of consent to jurisdiction
Upon receipt of a valid counter-notice, MineXHost will restore the content within 10 business days unless the copyright holder files suit.
8.4 Repeat Infringer Policy
MineXHost will terminate the services of customers who are found to be repeat infringers of copyright in its sole discretion. Repeat infringement is defined as substantive DMCA violations that result in multiple removals or court findings within a 12-month period.
9. Service Level and Uptime
9.1 Uptime Target and SLA Credits
MineXHost targets 99.9% service availability on a monthly basis. We measure availability based on whether your server is accessible through our infrastructure. The following SLA credits apply based on actual monthly uptime:
- 99.0% - 99.89% uptime: 5% service credit
- 95.0% - 98.99% uptime: 10% service credit
- Below 95.0% uptime: 25% service credit
Service credits are capped at 100% of your monthly service fee and are the sole remedy for availability issues. Credits must be claimed within 30 days of the incident. SLA credits are applied as account credits, not cash refunds.
9.2 SLA Exclusions
SLA credits do not apply to downtime caused by:
- Scheduled maintenance (announced with 24 hours notice when possible)
- DDoS attacks exceeding our mitigation capacity
- Force majeure events (natural disasters, war, pandemics, utility failures)
- Issues with your server configuration or third-party software
- Network issues outside our control
- Issues caused by your use of the service (resource exhaustion, misconfiguration)
9.3 DDoS Protection
We provide DDoS mitigation services to protect your server. However, we are not liable for performance degradation or temporary interruptions caused by automated DDoS mitigation systems. False positives may occasionally occur during attack mitigation.
9.4 Abuse Investigations
We reserve the right to temporarily suspend services while investigating abuse reports or security incidents. Such suspensions are precautionary and do not constitute a determination of wrongdoing.
10. Intellectual Property
10.1 MineXHost Intellectual Property
MineXHost branding, website design, and proprietary tools are owned by MineXHost and protected by intellectual property laws. Minecraft is a trademark of Mojang Studios/Microsoft. We are not affiliated with or endorsed by Mojang or Microsoft. You may not use our trademarks without written permission.
10.2 Your Content
You retain full ownership of all content you create or upload to your server. MineXHost does not claim any ownership of your server files, modifications, or data. Third-party content (mods, plugins, resource packs) hosted on your server remains the property of their respective creators.
10.3 Limited License
You grant MineXHost a limited, non-exclusive license to host, backup, transmit, and execute your content solely for the purpose of providing the Services to you.
10.4 Reverse Engineering Prohibition
You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of MineXHost proprietary tools or control panel software. This includes but is not limited to automated scraping, API abuse, or extraction of functionality.
11. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claim shall not exceed the amount you paid for services in the 12 months preceding the claim
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- We are not liable for loss of data, revenue, profits, or business opportunities
11.1 AS-IS / AS-AVAILABLE Warranty Disclaimer
SERVICES ARE PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MINEXHOST DOES NOT WARRANT THAT SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. YOUR USE OF SERVICES IS AT YOUR SOLE RISK.
11.2 Jurisdiction-Specific Limitations
Some jurisdictions do not allow limitation of liability for certain damages or exclusion of implied warranties. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law, and implied warranties shall apply only to the minimum extent required by law.
12. Force Majeure
12.1 Force Majeure Events
Neither party is liable for failure to perform obligations due to force majeure events, including but not limited to:
- Natural disasters (earthquakes, hurricanes, floods, fires)
- War, terrorism, or civil unrest
- Pandemics or public health emergencies
- Utility failures or power outages
- Telecommunications infrastructure failures
- Vendor or third-party infrastructure failures
- Government actions or sanctions
12.2 Notice Requirement
If a force majeure event occurs, MineXHost will notify customers within a reasonable time of the event and estimated resolution timeframe.
12.3 SLA Suspension
SLA credits and uptime guarantees are suspended during force majeure events.
12.4 Extended Force Majeure Termination Rights
If a force majeure event prevents service delivery for more than 30 consecutive days, either party may terminate the affected services with written notice. Customers will receive a pro-rata refund for the unused portion of their billing period.
13. Indemnification
You agree to indemnify, defend, and hold harmless MineXHost, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
- Your use of our Services
- Your violation of these Terms
- Your violation of any third-party rights
- Content you host or distribute through our Services
- Intellectual property claims related to content you upload or create
13.1 Indemnification Procedure
If MineXHost faces a claim subject to indemnification, the indemnitee will provide prompt written notice within 10 days of learning of the claim. MineXHost will cooperate with you in the defense and may participate in settlement discussions at your expense.
14. Termination
14.1 Termination by You
You may cancel your services at any time through your billing dashboard — the same place where you signed up. No phone calls, emails, or additional steps are required. Simply log in, navigate to your service, and click "Cancel." Cancellation requests submitted before the next billing date will prevent automatic renewal charges.
14.2 Termination by Us
We may suspend or terminate your account if:
- You violate these Terms or the Acceptable Use Policy
- Your payment method fails and invoices remain unpaid beyond the grace period in Section 4.4
- We receive valid legal orders or substantiated abuse complaints
- We determine your use poses a risk to our infrastructure or other customers
Except for severe violations (CSAM, illegal activity, active attacks), we will provide written notice of termination and an opportunity to cure within the timeframes specified in Section 5.3.
14.3 Data Access After Termination
Following account termination, you will have 14 days to download backups or export your data through our standard backup mechanisms. After 14 days, data will be permanently deleted and is unrecoverable.
14.4 Survival
The following sections survive termination of these Terms: Limitation of Liability, Indemnification, Intellectual Property, Dispute Resolution, Governing Law, and any other sections that by their nature are meant to survive.
15. Dispute Resolution
15.1 Informal Resolution
Before pursuing formal legal action, you agree to contact MineXHost support and make a good-faith attempt to resolve the dispute. Most issues can be resolved through direct communication within 30 days. Contact [email protected] with details of your dispute.
15.2 Mandatory Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising from or relating to these Terms or the Services shall be resolved by binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) under its Streamlined Arbitration Rules and Procedures, except as stated in Section 15.4.
- Arbitration Fees: For claims under $10,000, MineXHost will pay all JAMS fees and costs. For claims of $10,000 or more, costs will be divided equally unless JAMS rules otherwise.
- Hearing: For claims under $10,000, arbitration may occur via phone or video conference. For larger claims, you may request an in-person hearing.
- Individual Arbitration Only: Arbitration shall be on an individual basis only. Class actions, collective actions, and representative actions are not permitted.
15.3 Class Action Waiver
YOU AND MINEXHOST AGREE THAT ANY DISPUTE SHALL BE RESOLVED INDIVIDUALLY BY ARBITRATION, NOT IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. By accepting these Terms, you waive the right to pursue claims as part of a class action or representative proceeding.
15.4 Class Action Waiver Opt-Out
You may opt out of the class action waiver by providing written notice to MineXHost within 30 days of first agreeing to these Terms. Your notice must be sent to [email protected] and include your name, email, and the date you agreed to these Terms. If you opt out, all other terms of this arbitration agreement will still apply.
15.5 Small Claims Court Exception
Notwithstanding the arbitration requirement, either party may pursue claims in small claims court if the dispute qualifies under your state's or country's small claims jurisdiction limits.
15.6 Governing Law
These Terms are governed by:
- For US Residents: The laws of the State of Pennsylvania, United States, without regard to conflict of law principles.
- For Canadian Residents: The laws of the Province of Ontario, Canada, and applicable federal laws of Canada.
- For EU/EEA/UK Residents: The laws of your country of residence, with the application of mandatory consumer protection laws.
15.7 Consumer Rights
Nothing in these Terms affects your statutory rights as a consumer under applicable local law. If you are a consumer in the EU/EEA/UK, you benefit from mandatory provisions of consumer protection laws in your country of residence that cannot be waived.
16. Support Limitations
Support is limited to issues directly related to the hosting service. We do not provide:
- Gameplay support or server administration
- Mod/plugin debugging or development
- Custom configuration services (unless purchased separately)
- Support for third-party software issues
Our support team is available to assist with hosting-related issues such as server connectivity, billing questions, and control panel functionality.
17. Third-Party Services
17.1 Third-Party Integrations
MineXHost uses third-party services to provide certain functionality, including:
- Payment Processing: Stripe, PayPal
- Communication: Discord API
- Game Integration: Mojang/Microsoft APIs
17.2 Disclaimer of Third-Party Liability
MineXHost is not responsible for the performance, availability, or security of third-party services. If a third-party service fails or becomes unavailable, we are not liable for any resulting downtime, data loss, or service interruption. You are responsible for reviewing and complying with third-party terms of service.
17.3 Third-Party Disputes
Disputes regarding third-party services (e.g., payment processor disputes) should be addressed directly with the third-party provider, not with MineXHost.
18. Automated Renewal Compliance
18.1 Pre-Purchase Disclosure
Before you complete your initial purchase, MineXHost clearly discloses:
- The material terms of the automatic renewal offer (frequency and amount of charges)
- That cancellation is available through your billing dashboard
- That you will receive a reminder email before each renewal
18.2 Affirmative Consent
You must affirmatively consent to automatic renewal before charges are applied. By completing your purchase, you expressly authorize the automatic renewal charges at the displayed price and frequency.
18.3 Simple Cancellation
Cancellation must be simple and one-click through your billing dashboard. No phone calls, additional steps, or customer service contact is required.
18.4 Renewal Reminder
MineXHost will send a billing reminder email at least 5 days before each automatic renewal, including the renewal date, amount, and cancellation instructions.
18.5 State-Specific Compliance
These automatic renewal terms comply with the FTC Negative Option Rule, California Online Privacy Protection Act (COPPA), New York General Business Law Section 527, and other state-specific automatic renewal laws where applicable.
19. General Provisions
- Entire Agreement: These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and MineXHost regarding the Services.
- Severability: If any provision of these Terms is found to be unenforceable by a court or arbitrator, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Assignment: You may not assign your rights under these Terms without our prior written consent. MineXHost may assign our rights without restriction. Any attempted assignment in violation of this clause is void.
- Notices: We may send legal notices via email to your registered address, through the client portal, or via certified mail to your address on file. You may send notices to [email protected].
- Language: These Terms are provided in English only. Any translations are for convenience; the English version is controlling.
